hi everyone,
i am an american citizen that met my australian boyfriend 2 years ago online, i came over to australia in june of 2007 with an ETA. i have stayed all this time with extensions and renewals, fly to new zealand for a day and come back when i have to. we were trying to get a defacto visa but the fee is $2,105 and every time we try to save the money something happens. we lost our house we were renting and our car died. he lost his job, we have had things stolen from us, you name it, it has happend. we really have it rough but now, i am supposed to be out of the country within 2 weeks or have that spouse visa ready with the fee which i dont have. i know if i overstay my visa it will just be worse for me but i just want to marry the man, live and work here. thats another issue. i cant work with this eta. if i could, then we wouldnt be in this mess. what can i do? i dont have the money to leave and i dont have the money to stay. he tried to get loans but now with no job and bad credit it's impossible. do you think if i made an appointment with immigration and told them my whole story, they would just let me stay? i dont want to get deported and not be able to see him for years. he has a slight criminal history so i cant really get him to the US until we clear all that up. i really cant live without him. does anyone have any advice? anything at all would be apreciated. thanks for reading.

I doubt if anybody on here knows much about Australian Immigration.

Sorry to hear about your ordeal, I guess you have no choice than come back to the US, Iam sure the US Embassy in Australia is able to help you there, the risk of over stay may be too big and a chance you cannot go back to Australia.
I know years ago my parents had friends and they got married in 2 different countries, she was in the Netherlands and he was in Brazil, they called that marriage with the glove( translated from Dutch).

Would that be possible here too I wonder, just an idea

Unless its drugs or a CIMT ..it may be possible

Without a good attorney someone with a criminal record is not going to get into the USA...even if they were able to afford the airline tickets and it appears that Midge and her fella don't have any money (otherwise they'd apply for the spouses visa). I'm probably an old cynic but I do wonder when you are in a (immigration wise) complex relationship with a guy that has no money no job and a "slight criminal record" if its not better to just to cut losses and return to the USA. If the relationship really is love and is going to work in the long term, then a period apart will give you both the opportunity to work and save so that you can do this properly.
