View Full Version : Fiance has an E2-What do i need to do?

Hi,

I am Claire from Manchester UK and i would be very grateful if anyone can point me in the right direction please.

My fiance has been offered a permanent position in California USA and as a result he is going through the application for an E2 employee visa, so i was wondering what i will need in order to join him? I have looked into it a bit on here and there is such a thing as an Derivative E2 visa, he will be coming back to the UK whilst his visa is being processed, so we have both talked and agreed to get married whilst he is here, unfortunately a quick wedding, so i can go over with him as his wife.

We have been together since leaving high school and are now both 25, so we are more than sure that that kind of committment is not an issue.

If we get married, what is the process i will need to follow in order to request the Derivative E2 ( please note that i will not be requesting an Employment Authorisation just yet, it is mainly for the support ) Do they carry out any kind of background checks? If so, how long will the process take? I can easily attend the Embassy in London etc, so how long would i be in the UK without my partner?

Any advice would be greatly appreciated :)

Once u r married you are filed for by his employer as a derviative/dependant and when he gets his visa you will get yours

Well my partners company would like to start the process of the application immediately, therefore that means, whilst we are not married and do not have a marriage certificate to give to his company for me to be filed as a derviative? So what will we need to do if we get married whilst his visa is in process? Can i be added to it at a later date when we have the marriage certificate? Or.....

It only takes three days to get a special license, lol :)

that way you can both go on the same application

What is a special licence?

From what i understand, the quickest way of getting married is through a registary office, which you have to give a notice of marriage, myself and my partner and he is not back in the country until the 23rd June, then we can get married 15 days after the notice was given, that means then getting the date for the actual wedding, i am going to give them a call today so i will let you know what they say :)

The main thing that concerns me is, will it be dificult being added to his visa at a later date? After we are married? My partner is going to speak to work today regarding this.

Oooo i have just checked my mail and my partner has been looking into this, he has forwarded me the form i need to complete to be added onto his visa as a derivative at a later date and all they request is a copy of his E2 visa and my passport :) So seems pretty straight forward, thing is, this information was from a forum in 2007, so can anyone confirm this still stands? And the Embassy in London still carries out this procedure?

All i need to do now, is get married before his company blow the whistle for him to start work :) Well i think they can actually wait, dont you? :)

Make them wait and play safe but yes you can be added as a wife dependent at any time

I just read that your on your other thread - the welcome one, that your fiance has been offered this E2 employee position by the company he works for in the UK.
If that is the case, then IMHO his employer would be far better applying for your fiance an L visa as an 'intra-company transferee. That way the Green Card route opens up for him, and you.

I just read that your on your other thread - the welcome one, that your fiance has been offered this E2 employee position by the company he works for in the UK.
If that is the case, then IMHO his employer would be far better applying for your fiance an L visa as an 'intra-company transferee. That way the Green Card route opens up for him, and you.

But it will cost the company more ... and it will probably be a L-1B
labor cert will be required for GC unlike the A

Hello all,

Ok so my fiance has been offered an L1 visa now, he got it wrong ( men ) ha ha so he has spoken to them and i can go over on it :) So all seems ok, we are giving our notice of marriage next week and the registrar can get us in near enough straight away... So it all seems to be ok ( for now )

I shall keep you informed.
