Just a quick hypothetical (cant spell) E2 question

If you have an E2 visa. You bought a biz and were granted 2 yrs for example. You then shut down that biz (for whatever reason) and open under another name (in same field but different name). Do you need to go back to home town (or at least USCIS in the US to do status) and reapply for a visa under new biz name or is the visa in your corporations name? If it is what I think (the visa is issued to your dba name) and you havent changed with embassy does that put you here illegally and therefore trading illegally?

We thought about this one as we considered for a while selling our Inn and buying something larger that may get us more assurity of visa reissue. We set up a corporation in a generic name and are DBA Inn Victoria. The E2 was granted to the corporation not the Inn. If we sell the "asset of the business i.e the Inn" and buy another then the business is still effectivly the same. However if we closed our corporation and did something radically different then we'd have to do a new application.

Innvic is correct. Its the business entity that actually gets the visa and it gets its own company visa number as well. If you look at your passport the business is listed on the visa. If you have set up a corporation that holds the business then that’s OK, change assets all you want. Otherwise you are going to have to start again.

there is nothing stopping anyone from having a main company and lots of subsidiary companies so long as the main company owns the other companies 100%, if that makes sense

Any attorney who has dealt with E-2s will always recommend forming a corporation under which the business is started, not applying for the E2 on the basis of the specific business.
