Hi all, I just discovered this site. Was wondering if anyone could help. I'm a Nigerian (on an H1B) engaged to a German national on a J1 visa. We're both physicians and he successfully applied for -and received - an approval for an O-1 petition (for outstanding research scholars). He did this as we're getting married on September 5th and couldn't find a J1 waiver job where we live. Our lawyer advised us he would still be subject to the 2-yr requirement on the O1 visa, which he could complete over time) or until he gets a waiver job.
He left in July and went to the US Embassy in Frankfurt (his grandmother was sick so he thought he would see her as well) where they told him they didn't think they could issue his visa and told him they would contact him. This was around July 18th or so...We've heard nothing since. Whenever we've called, they have been quite rude and told us to just "be patient" and that they are "making enquiries". They think he needs to do his home residency requirement before returning to the US. They clearly are not aware of these exceptions provided by USCIS, who approved his petition in the first place. We've contacted the local congressman through the district where his hospital is located and they have said they will look into it for us.
We are so worried and nervous. I don't know what else to do. We have a wedding and everything is in place. I think we may have to cancel. If he'd gone to Canada, I feel this may not have happened. We didn't see this coming AT ALL. Aside from the Congressman, any other suggestions? How long do these type of "enquiries" take and who would they be contacting? Our lawyer sent them all the evidentiary information on this and has called multiple times but they remain mum on it. I am out of my mind with worry. We have family coming from all over and don't know what to do. Any reasonable suggestions are appreciated.
