View Full Version : E2 Visa renewal and I130 petition for alien relative

Hello everyone,

I'm renewing my E2 visa for the third time and I was initially here on a E1 visa for the first 6 years.
My question is I had a petition for alien relative filed on my behalf about a year ago and I'm being told the current wait is about 6 years.

How do I handle this on my e2 renewal ?

I'm assuming by enclosing a copy of the application and stating it in my cover letter or in my letter saying I'm going to leave when the E2 is over. The fam notes that it there is nothing to prevent a e2 holder "being fortunate enough" to have a alien relative petition filed on there behalf".

However how do you square this against the letter saying your wanting to leave the US after the E2. One thought of mine as to why the petition has been filed is that it is the only way to ensure I get some of the social security I'v spent 17 years paying into. Should I just state this with the documentation ?

Any suggestions ?

Any general advice from anyone who has gone through a renewal recently ?

Problem is you are filing for a non imiigrant visa when you have already filed a Petition for an immigrant showing an immigrant intent
Suggest you pay a visit to a good immigration attorney asap

Petition was filed by a attorney and I was told at the time that it was not a problem for my e2 which I am renewing, I just had to declare it. The FAM guidelines say that this is possible. The relative is my mother. Seems odd that it can't co-exist with my e2 visa, after all it can take 6 years for the citizenship to come through and if my mum doesn't live that long its all irrelevant.
I'm not using the attorney for the renewal but doing it myself. However it's changed quite a bit since the last time round and I'm finding this forum invaluable for updating me.
