Hi
Does anyone know what the deal is if you get a divorce in the US and are on an E2 visa, married in the UK?
Anyone know of a good divorce (cheap) lawyer in Central Florida

R U the dependant or the E2 visa holder
if dependant then as soon as u r divorced u lose status If the visa holder the husband suffers that fate

You are ok then as long as u retain your ownerships post divorce

But surely even if it were a 51/49 split they dependent would be able to stay until the expiration of the i94

the only problem may be at renewal - as you would be treat as separate entities - so the investement and profit etc. would have to be enough to support 2 applications.
Its always sad when a marriage breaks up - and the strain of this visa doesn't help. Good luck for the future, things will work out - I've been through it twice but you do find light at the end of the tunnel...and eventually I met Mr Right :-)

Sorry to hear that. Can I ask if the stress of moving here contributed or would it have happened anyway?? Will you be staying and your husband going home?? You cant both have the E2 business, unless you feel you can carry on working together of course.

We are both staying and working together amicably, as we also have a daughter. My husband has rented a place just up the road so all is fine there.
With respect to it being related to the stresses of being here, I dont think thats played too much of a part, I think it would have happened eventually anyways. The only thing which accentuated it possibly was the fact that we work from home, so live/work together and didnt have any outside interests. Also we had no "on hand baysitters" so never had time to be a couple it was either work or me looking after our daughter and I got bored and crazy :)
Things happen for a reason, but Im certainly happier by far, despite being stoney broke and a single momma, Id still rather be all of those here than in the UK with money etc and miserable!

If you are going for a renewal soon, can I suggest you postpone divorce and say nothing as if not you will need to show the business is capable of supporting 2 separate families

We were thinking of doing the renewal prior to the divorce as according to a website I found you cant file for a Florida divorce until you've had 6 months on your DL so that puts us just a couple of months prior to renewal so was thinking get through renewal then worry about the divorce? Dont see as why it would be flagged as we would still be married, as long as I dont submit any petition for divorce.

I meant even if they were divorced!!!! If they went as mr and mrs why would divorce be in question?

I am so sorry to hear that, I know how difficult things can be, we have for ever worked together , sitting on each others lip and not be able to go somewhere together.

Why would you get a divroce anyway , living seperately and see if you come across someone "new" for both of you, than you might never have to worry about E2's anymore
