I have just been reading on EB1/EB2. Does anyone know anything about this or have or know anyone who has experience in relation to it?
I have been reading that this does not require that it does not require labor certification and/or a job offer in all cases, or is this not the case? Also there are three types: EB1-Extraordinary Ability; EB1-Outstanding Researcher or Outstanding Professor; or EB2-National Interest Waiver.
Would be interested in any thoughts.

Not at this point, but I am working on something major in the field of securities and corporate governance so I could well be in the not to distant future. However, at this point in time my family-based petition is the best way forward if I am able to sort out an issue under the CSPA (or if by some miracle something turns up in the Comprehensive Immigration Refom Bill). Wish Sen. Kennedy would get a move on and publish it already.

EB1and EB2 visas are whats called first preference workers within that category or people with extrodinary(wrong spelling) abilities.
it works like this you have EB1 which is first preference( arts sciences etc, doctors)
EB2 second category which is Skilled workers, who can prove that there is nobody in the US that can fufil that role.
under this there are sub categories like
EB1C which is for multifunctional executives or managers ie people here
on L1A visas, who qualify under the first preference sub category C.
and so it goes on like that really.

also forgot to mention that these first preference workers are for people who are applying for adjust of status to permanent residency.
once the immigrant petition has been approved from USCIS, due to the fact they are first preference workers, it does not take very long after immigrant petition approval to be assigned a number from the USCIS which is your greencard number.

:eek: :eek: :eek: :eek: There is lot going on here .......so I will keep it very simple.
EB1 and EB2 and as a matter of fact EB3 are Not VISA.
They are the Cat... to determine your adjustment of status according to your qualifications and your USE for USA.
When employee is hired under H1b and they are ready to change status some fall under EB1 Cat and the Gc process is faster but very hard to get approval as it demands more than one normally would have ( wont go in details) Some times EB1 and EB2 both do not LC so one step is eliminated in the process.
EB1-Outstanding Researcher ...
EB2-National Interest Waiver....( when they come with skills that USa can use for example Beckham)
EB2 is generally filed for university prof. and software Eng. who have ample number of experience with masters degree in hand... they do have to follow the LC process but sometimes not( if they have many awards and international standing on their work) but than you have to fullfill certain requirements for that waiver.
EB3 is for all other employes hired for jobs by companies around usa.... computer progm.eng. also fall under that cat where the employer does not need a masters degree and Exp. in advertisement (for the position).
These (EB1,EB2 & EB3) are not VISA's these are cat to determine your change of status.....One must have a valid Employment Based Visa to to fall under these Cat ...And the employer Must file for your LC and than sponser for your I140 application...I485 is employee application though it can only be filed along with I140 or after I140 is approved ....Depending on the law prevailing at the time of filing these applications......Hope it is clear now.

The petion is stil AOS ( I140 + I485) .
once the immigrant petition has been approved from USCIS one gets Green Card.
There is NO NUMBER ASSIGNED FOR GREENCARD.
As I explained these are diff. cat where you fall to adjust your status.
These Cat. also define your job responsibilities/ salary/ educational qualifications/and your legal status as an employee.

er reply to v2002 you do have to await a number to be assigned that is what the greencard number is once a number becomes available then a greencard is assigned to you.
had a very long chat with husband of an american who came here to live from essex in UK he explained how the process works.
unless of course he could by telling lies?

Honestly tracifrost.....I am sorry to say " I would never assume anyone's husband will tell a lie" I think he misunderstood " visa number" with greencard number.
after you file you must wait for a visa number to be assigned ...after that number is assigned your Gc application is approved or denied.
Once you have an approval on I-485, thats the end to all nightmares.You are greencard holder from the date of your approval.
The only wait you have is to get your CARD in hand.
Hope this clears the misunderstanding.
