Can we keep this thread purely to discuss Strive act, ways it may be able to assit us and our current efforts for immigration reform
As many of you may know expatsvoice has two main aims for immigration reforms, to clarify these are.
Protect ALL children aging out whether, illegal children, L dependant or E dependant children
1. To obtain an amendment to The Dream Act or CPSA both acts are badly written and need a leglislative fix.
The Dream act is too restrictive,there is No provision for legal children who become out of status at 21years. eg, E dependants, It is all about illegal children. They must have entered the USA before their 16th Birthday, complete 5 years of education and be of good moral character.
There will be families whereby, two of three children of the same parents will be protected and one of the children may not be. Either they have been brought to the US a day or so after their birthday or they may have downs syndrom or other medical or learning difficulties.
The CSPA is also badly written as children are still aging out despite the spirt of the act. due to visa numbers available and other reasons. There is NO provision for dependant E 2 Children in the CSPA so this is what needs to happen
So we must concentrate on getting an ammendment to either the Strive Act, CSPA or Dream act to include E visa dependant children. If brought into law once the children have a green card they inturn can sponcer for their parents. I appreciate it could well take a very long number of years but as soon as the children can apply for sitizenship this will reduce the wait time for their parents.
2. Compassionate visa Death of Main visa Holder and other cases
As many of you are aware sadly my husband passed away a few months ago. It was his and my dream to make a difference to the current broken immigration system
If the main visa holder passes away the spouses work autho is immeadiately cancelled. The spouse can inherit the business, pay tax on the inheritance but not the visa status and technically leave the us immeadiatley.
Landlocking
There have been cases when visa holders are waitng for renewal and landlocked in the USA. Some of our own members loved ones have passed away, including, Grandfathers, sisters, best friends etc., Whist anyone can leave the US ( no one can stop them ) if they do they would then be out of status and only return to the us on the visa waiver. A compassionate visa could cover a mulititde of case senarios on a case by case basis
