lets just say we want to retire, having got green card, but have family members that are having issues with there current visa.

can we give buisiness to family members, sell 51% to them.

any suggestions on how we can help them be more secure and which visa/way to go about it

Yes you can sell your business to family. If it is for an E-2, it must be shown that they paid for it with their own funds. Dont really understand your post, are you saying they are already on E-2 but not doing well??? If so you would need to sell to their holding company which would own the newly acquired business as a DBA.

susie, what should have been a easy green card for family members, has turned into a nightmare, because immigration official behind a desk somehere, read facts about education clearly wrongly, ( even our immigration attorney) has no idea how they can read such simple facts wrongly.

but they have the power, as we all know, which has resulted in having to go down the appeal route, which is taking forever, so keeping family member in status is not only costly, but frustrating.

although we know the facts for the appeal are straight forward,and we should win, we have lost faith in the system, and we are trying to make sure we explore every avenue, so any thoughts or ideas about giving our buisiness to family member would be helpful

or in fact any other ideas.

So they applied for a green card and got turned down ( frankly have no faith in the appeal system myself). If selling them a business so they can apply for E-2 please note that the spectre of "immigrant intent" which isnt allowed on E-2 may raise its head.

To avoid pure guesswork on the part of readers, perhaps you could just expand on things a little?
You are on GC's running a business in FL. Is the business a corporation or not?
The family members having visa trouble. What visa are they on at them moment? What is their issue and what are their ages?
If you offer that extra information, it helps paint a better picture and greater understanding.
