Hi all I have just found out that my Grandfather has had a stroke, I knew he wasnt well but everyone been trying to keep things from me as they know I cant travel back to uk. My renewal of i94 is in vermont still (L1) visa. I am desperate to go see my grandad. If I flew home visa expired on the 24th june is there any way back???? What about on visa waiver???? anyone any idea how I can go see my grandfather.??? Thankyou Kind regards Lorraine:(

hello lorraine, i would bet on a normal day you would only have to explain your situation and sail in and out,but on another day you could get knocked back, with the situation at the embassy i think personally you need to wait for your paperwork its tough on you but who knows what could happen sorry

Hey Lorraine,
Sorry to hear about your grandfather.
You are now in the same position as many have been before you and many will be after you. Some with closer kin than grandparents too.
There's not much you can do as a certainty to a return. Explanations of travel for a sick relative falls on deaf ears at the point of entry, and all they see is black and white that you travelled and had no conclusion to your renewal and no advancement of parole.
I believe there's an emergency route for advancement of parole (as normal waiting time is anywhere between 3 and 6 months), ...........perhaps someone on here knows how to do it??
If you DID leave and tried to return on visa waiver, you will have to complete the section that asks whether you have ever applied for a visa before, which will open up a shopping cart full of worms, and it's basically a coin flip on whether you'd get back in or not.
Pray for your grandfather, send your best wishes and go see him when you have green card!

Hi Steve and Bobby thanks for the replies. I have sent message to my attorney see if she can come up with anything... My grandfather brought me up so he is a father to me very very close he is 84 and I so desperate to get home and see him. I never realised we could not travel. I thought once the 194 card was renewed we could then travel abroad. Oh how things are not explained when you first decide to come over. Also what I dont understand is I have a business in England, we buy from China, we need to go to furniture shows all over the world and you cant travel. (MADNESS TOTAL MADNESS). I keep checking USCIS site for vermont and they never update the status it has been the same since 20th June, so who knows how much longer for renewal!!!!!!!!! I know of two pepple pending renewal whose parents have died and they have been unable to go back for the funeral. If you go back you may have to wait in the Uk until your visa is approved, if you havent premium processed it is taking around three months,

Hi Lorraine,
Hopefully your lawyer may be able to come up with something. Keep your fingers crossed, but I think if you're adamant about travel, you may just have to risk it.
I'd be very pleased to see your petition as you have kindly offered. You know my E-mail address. I look forward to it, as you're right I need to get a move on!!

Hi Julie even when I do get the renewal, I cant travel back with that as it is only a renewal of I94 card. Some people telling me that you take a risk going back as you then have to go to Embassy in London and get new L1 visa which apparently some people are getting turned down when they get there. Obviously I just cant take that risk we have business here in Uk home and son of 13 in school. I would have thought once you got your renewal from vermont you would automatically be able to go to London and get your visa stamped again, it really dosnt make any sense. Why do they ask for all the stuff for renewal but this does not grant you access in and out of the country. I dont know all a joke:rolleyes:

I am so sorry about your grandad and if I were you I would book an info pass and go speak to them
Go to www.uscis.gov you can book an online appointment but not sure if they will or can help
It appears you may need advance parole as this is a travel ducument which will allow you to re-enter the USA and not abandond your status
This is yet another reason which is why Sue needs support to petiton for an emergency visa that with proof and documentation of situation people should be able to walk into any US embassy/ US airport/ service centre or sub office for an immeadiate visa once verified
No one can stop you leaving the USA as this is your right but they can stop you coming back in to the US as the final decision to allow anyone in to the USA rests soley with the officer at the POE (port of entry)
