During the recent seminar one of the questions was about EB5 GC visa by making a passive investment in , property (one mentioned was warehousing in Seattle), or a cattle ranch in Texas.
The attorney stated categorically "There are NO passive investment EB5 visa's" In his years of experience these scams appear every year and the investor has ALWAYS lost at least their cash and sometimes their ability to enter the USA.

I was thinking of doing this EB5 thing with a firm in Seattle, are you saying the warehousing is a scam and what firm was it?

Hi Andy,
I cant remember the company, however the gist is that the EB5 is one of the hardest visa's to get, only a couple of hundred issued out of 10000 available each year. The Business plan, source and application of funds is heavily scrutinized as are the results when you are running the business for the 2 years plus probationary period (or whatever its called).
If you are even thinking of going this route check with an independent attorney. Mine says ALL of these deals are scams and has recently taken the "Florida" magazine to task for publishing such rubbish, they are publishing a full withdrawal in the next issue (we will see!_).
If you have the full money required, then do it the proper way, there really are no short cuts

Neil ...indeed their are scam .. mainly deferred paying of monies and the outrageous fees charged by lawyer.. Indeed passive investment is not what congress wanted ..but the scheme allows for indirect employment..
I quote a piece from Carl Shusterman..arguably the number one Immigration lawyer in the US ..
In the mid-1990s, the INS created the Regional Center investment program
which is ideal for inactive investors, retirees and other potential
immigrants due mainly to the "indirect employment" feature of the
program. The investor may be a "limited partner" and 10 employees may
be hired by the general partner under the less restrictive "indirect
employment creation" clause which allows the investor to qualify for a
green card without personally hiring 10 persons. The investor need not
even reside in the same part of the U.S. where the investment is
located.
There are some 27 regional centers now .. some are being promoted by the State itself ... rather than the nefarious agents who seem to have jumped on the bandwagon
For those who do not understand the "indirect employment" feature
read here in USCIS language ..also note this piece:
The regulations require that the alien investor is or will be engaged in the management of the new commercial enterprise, either through day-to-day managerial control or through participation in policy-making decisions for the commercial enterprise.
