My wife has GC thru Asylum based adjustment of status. She has not seen her sick 85 years old mother in 10 years. Both cry when they talk on phone; mother wants to see her daughter before it is too late...
How can the daughter travel to that country from which she sought asylum? And on what document (that country's passport -which stands expired or the Refugee document - that may need visa of that country on refugee document - will refugee document cause problem at entry in that country)? Will it create any problem on re-entry to USA?
Please someone advise us.

Which country did she seek asylum from? as this may be important when giving you advice on traveling. Have you spoken to an immigration attorney?

Hi,
My advice would be to speak to a good/recommended/AILA regstered immigration attorney. I know this will cost, but it sounds like you are in a distressing enough situation without risking travelling on advice from (all be it well meaning) laymen.
Now as you all know -I'm no fan of attorneys in general, and our corporate attorney doesn't deal with immigration matters so would be little use to this guy....can anyone recommend a good AILA Attorney?

I would not have thought that the Mother would want her daughter to risk her life visiting her.
Perhaps thee is a third country that they could met up in which both have access to?

I would look into if you can go back...you get Asylum because your life is in danger if you return home...if you feel you can go back for a visit...then you could lose Asylum....

If she has a green card she will be allowed back into the usa and free to travel anywhere she wants too so of course she can travel to see her mun but would she have any reprocusions in her home country

Thankyou folks for the inputs; it is slightly tricky. While she has to be careful not to get exposed to the dangers of religious persecution back home, she must also see her mom before it is too late....(mom is over 85 and unable to travel for health reasons). Of course best is that we must speak to an attorney but they charge a fortune to give advice!
The issue is two folds: one the home country will want to know basis of residence in US before they reissue / renew passport and that will give away that asylum was sought here and the officials and government do not like that people seek ayslum to avoid religious persecution back home because this exposes religious terrorism and human right issues; second is upon return US immigration does not view it favorably if one visits home persecuting country after the grant of asylum.
Here is an issue of sensitivity of human relations - aged and sick mother who lost her young son about two years back has not seen daughter in 10 years and daughter who lost her younger brother who died at age of only 44 couple of years back and she could not even attend his funeral and now fears the fargile health.

Personally I can't see any way around it - daughter leaves USA she'll have a tough time getting back in as the authorities may see it as 'if you can go back for 2 weeks, why did you need asylum?' and mother is too sick to travel that far.
Could the mother pop over the border of wherever it is we're talking about, and the daughter apply for the 'parole to leave' documents to meet her in the country next door?

I would definintely seek legal advice. I'm sure I remember a recent story posted on a thread on this site about a similar story regarding someone who returned back home and I think they were not precluded from seeking Asylum - but I could be wrong.

If she has Green Card, surely this means she can travel - I too read it as still waiting for status adjustment. Might be worth having a word with the relevant embassy (as we still don't know which country we're talking about!) Surely they can only take it away if tehy suspect the original application was fraudulent, or if she starts smuggling hard drugs etc?

I do think you should speak to attorney to be sure and if you are on a low income go to www.cliniclegal.org they are not for profit and you do not have to be catholic for them to help you. They card $40 for the first consultation, so not too bad and have over 600 attorneys that belong to this site
You say your wife has green card, so if she went back to home country all she would need is to show her passport of home country to be allowed in
She will only need to show her green card to immigration in the USA when she returns, so ask would home country need to know about the green card?
Can she go back to home country and return to USA before her passport expires? If her passport needs to be renewed is their a consulate for her home country in the USA when she could renew it?
