Hi I am new to the forum.My partner and i (now my Husband) arrived in Florida March 2005 both on separate L1 Visas, mine was for 1 year, his for 3 years. My renewal was denied in Feb this year and is currently under appeal. We then got married in July, and our attorney has advised i change from L1 to L2.
Does anyone know if i do need to go back to London for this, if so will i be granted the change of visa on the day or will this take time,as obviously we are still trying to run a business in Florida.Also i will be travelling with my 11 month old and leaving my four year old with my husband in florida, so i really need to know if this is something that can be done very quick!!!


Any advise appreciated.

Unless you need to travel and need a visa just change status with USCIS and get L2status and an extended 1-94 and leave the embassy alone would be my advice. What sort of business got denied? Not many L1 renewals getting through at the moment.

Just a thought, can your husband submit I 140 and I 485 for himself, This is adjustment of status to LPR and at the same time file an I 485 for you as his dependant?

When was your husbands L visa approved and how long is left on the visa?

Has you immigration attorney said this would be an option after you file as
L 2 ?

If your L visa is under appeal and therefore the L visa for yourself was denied then technically you do not have a visa at present. Your case is complicated and urge caution. I think you may need to file for and get a travel document. Have you mentioned this to your attorney?

Thanks for your replies. I have an appointment with my attorney on Thursday i will mentions everything that you have quiried Mark. Unfortunatley my visa was turned down against..............my Property management co!!!! No suprise there! My husband has 18 months left, he bulids software for "smart homes" and also has a long term rental company. I would really not like to go back to the embassy in the Uk as i would have to take my 11 month old with me!!
