Hi!
I am new here and am glad to have bumped into this site as it is very informative and helpful.
I am currently working here in the US under an E-2 visa. But at the same time, I was able to find an employer who is willing to get me a green card. I already have my Labor Certificate approved and is currently waiting on my I-140 approval.
Given this situation, does anyone among you know if I can leave the country and safely go back? Although my E-2 visa is still valid until 2010, I am worried that I might be deported as I re-enter the US. You see, there might be a conflict between my E-2 visa and my current green card application. E-2 visas does not have a dual intent and yet I am applying for a permanent residency.
When the immigration officer checks your visa and identity at the port of entry, can they see and know that you also have a green card application on-going?
Will the E2 visa be cancelled when you apply for a green card?
I hope somebody can help me.
Thanks a lot!

Do nothing, do not travel. Just wait for the green card, and hope they do not pick up on the fact you are here on an E2 when you are adjustnig status .

Agree with Peter. Why (unless you positively have to) rock the boat - just not worth the hassle in my eyes.

Are you E2 holder or spouse? If E2 holder I'm curious how you can get an employer to sponser as the SS number for E2 visa does not allow to work outside your own business

Hi and a warm :welcome:
Yes please tell us a little more of your current situation, so we can figure out your situation.
I agree with others,on the limited information., that is until such times your have a receipt number for your I 140 and I 485, and an approved travel document, I would sit tight and not draw attention to myself

If you are only waiting on your I-140 approval, then you are free to travel. But, if you have an I-140 pending, why not file your AOS I-485 as you can before Aug 17th. Once you file your AOS, and before your green card is issued, you should have an approved travel document (advanced Parole) before you re-enter the USA. This is because the E2 is not a dual intent visa unlike the L1 or H1B. I suggest that you contact your attny and ask about filling your AOS before the visa cut off dates are put back again.
Good luck
