Just heard some good news.
E2 visa granted for 2 years for a painting company.
Investment $175,000 for a mother and 18 year old son ( so no ageing out). Filed 12 weeks ago.
They purchased not subject to E2 and got away with managing company by each coming in on visa waiver for 90 days.
I am more optomistic London is getting faster and more tolerant.:)

Good news Peter - surprised they managed to get away with "running" the business on VWP.

They never told anyone they wre running the business did they !!!
Significant fact is the amount for 2 investor visas

Thats such great news Peter, I am so pleased for them, Maybe they would benefit from joining our site and efforts so maybe you could invite them to join?

To be honest I am a bit surprised that an 18 year old qualified jointly with his mother, but kudos to them

From what I understand people can come on the VWP to oversee the running of their business. They cannot do manual labour nor get any sort of payment whilst on the vwp, have I got this correct?

Hi All,

Just to let you know [I may have mentioned this in earlier posts]. After we purchased the business my husband has been going back and forth on the VWP for the last 10 months, he was open and honest with homeland security at Houston IAH and said that he was coming in to oversee his business and that he has an E2 application in process at the Embassy in London, never once did homeland security take him aside and question this, he also never stayed the full 90 days he always came out around 86/87 days.

When I travelled out to Houston with my husband at the end of April this year [my 2 week vacation] we were not sure how homeland security would view us as I was on the VWP for 2 weeks and my husband was obviously in for his 87 days, he did question this as we both independently completed the 194 forms, we explained why and he was happy with our answers.

The interviewing visa officer at our interview picked up on this and although he was not too happy my husband had done nothing wrong and homeland security at Houston IAH obviously had no problems wITH him doing this. The other thing to remember is that you can go in and out on VWP for up to 180 days in any 12 months, if you were to exceed this then I suspect that this could be seen a some sort of violation?

Please note that my info above comes from travelling to Houston not sure if this would be the same anywhere else in the US?

I will send another post once I have arrived in Houston, I leave UK on Sat 29 Sept and I am so excited, our passports arrived yesterday from London so I feel a whole lot happier now I have seen the visa.

I do hope your right about the American embassy. Such good news for them please congratulate them from us
