I have a new friend who is here on an I-140 visa. She tells me her daughter, who graduated high school this year, cannot work or go to school. Now the girl has run off to live with a very unsuitable guy and her mother is frantic. My friend believes her daughter's non-status is to blame, as the girl began hanging out a the beach because she had nothing to do, and met this "bum".
I want to help her but I'm not sure about this particular visa. Does anyone have any advice?

I-140 is not a visa, it is a form to file for an immigrant visa petition.

Can you tell me what is involved and how my friend's daughter will be affected? She's 18 - can she stay after 21 if the application is successful?

NinaHi Nina ,I am a bit confused by your posting,is your friend applying for a green card?If she is then her daughter should get one to as she is under 21,can you give us a bit more info?Take care.

I don't know her well, we have only emailed each other and she told me she is here on I-140. I do know that she has had some very bad advice - like her daughter should get married or pregnant in order to stay!! I know that her papers have been lost several times, but I'm not sure how she came to be on I-140. What status do you have to be to do this? I just don't know anything about it. She was married to an American citizen but is now divorced. Could that be it?

There are only a few ways to obtain a GC. One is through family sponsorship, one through Employment and investment, one through diversity and one if you paddle on a small boat from Cuba. I suspect that your 'friend' has told you half of the facts from half a story and so you really only have a quarter of the information. Post more if you can.

Nina.Hi again Nina,mmmmmmmm like David says an I-140 is just a form it isnt a visa,without knowing more about her actual status,it is really hard to advice on this one,do you know who told her daughter to "get married" or "get pregnant" thats very strange advice to give,and also who lost her papers???Dont know about the American citizen marraige bit,perhaps the best thing she should do is contact a good immigration lawyer,and do it asap.Sorry I couldnt be more helpful,but wish her good luck from me.

I'll try to find out more. I know she was here on an L1 because she had a practice in Germany. I've told her about this site, so perhaps she'll join us and we'll find out the full story.

You need to find out if she also filed I 485's concurrently with the I 140 for all family members too. If the I 140 is approved this is the go ahead to apply for green card. If the I 140 is denied she can appeal and be legal whilst the appeal is going through but if denied everyone is out of status

What I don't understand is what criteria have to be satisfied in order to be eligible to apply for I-140? If there is a way to do it for my friend, why can't E's & L's do it, too?:confused:

Nina.Hi Nina,you can apply for I-140 if you are on an L1 visa,but not on a E2 visa.
