I have been trying to research to see if you have an appeal pending are your legal to stay in the usa
It was my understanding that whilst you have an appeal pending you are legal to stay in the USA until such times denied by the BIA
I know this is only hearsay but been told, yes the person is legal but if denied then illegal presence goes from the date that the I 94 was stamped
It is so hard to find out exactly what the stance is. I think I will call the 1-800 number to see what they say, but unless they can direct me to where I can read up on this question, we must rememeber it is only one person's opinion so again will be hearsay
