View Full Version : 'Status' - what exactly is it?

Hi All

The thread recently posted on here by Sue - http://forum.expatsvoice.org/showthread.php?t=542 - has got me thinking, but I didn't feel that it was appropriate to ask my question there, so.....

It's my understanding that the date stamped (or written) on the I-94 of an E-2 Dependant by the Immigration Official when they enter the country dictates when they have to leave the USA. That is, as I understood it, the 'Status'.

My question is: on what authority, or on whose authority, would someone with a valid I-94 (excessive of 30 days, of course) be told to leave the USA within 30 days?

I heard about this case in a recent article but cannot remember which one, perhaps someone can remember

The lady was a dependant E visa holder. She received a letter from Texas stating that her visa was cancelled the day her husband died giving her 30 days to leave the USA.

She could inherit the business but not the visa status as it was her husbands investment not hers.

Status is given by an approved petition and visa stamped in passport but this can be removed by the uscis, department of state, department of justice or the immigration officer at port of entry.

At anytime if they wish to revoke a visa they can, even if you have a green card. You could end up loosing it, or having it confiscated especially if you commit a crime or stay outside the USA for 6 months or more without a re-entry permit

Whatever sort of visa stamped in your passort makes no difference, the final decision to allow entry into the USA rests with the immigration officer at the port of entry
