View Full Version : Lawyer cheated Urgent please help me

I am pretty new to this forum.My lawyer cheated me. I field I-140 and 485 concurrently. There was a RFE on I-140. DHS gave 30 days to respond but lawyer did not respond with in the given time and he told me that he forgot and he did not respond to the RFE. I called him and reminded him 4 times in that 30 day period regarding RFE, it looks he never cared my calls to remind him. He is one of the desi lawyers in the bay area CA. Because of him I lost so much of time and lot of mental tension. I called him for the solution for this and he was kind of rude and he does not answer my phone calls and he says he is busy. He is behaving so unfair. What can do to get through this? Your valuable suggestions are appreciated.

I am so sorry for your situation. Ref are so important and must be filed in a timely manor otherwise they will deny and close your case
Have you contacted your congressman? If it were me I would book and appointment to see him and explain. They have special e-mail to service centre so have direct contact with supervisor in service centre
Did you send attorney any faxed letters during the 30 day period? or did you e-mail your attorney within the 30 day period?
Is your immigration attorney a member of any assn? like AILA (American immigration lawyers Assn)
You may find yourself having to re-file your case, however you may have some redress as you say your attorney FORGOT to deal with you case in a timely manor

Hi OH1BOYGC?, HAVE YOU TRIED GOING ONTO CONGRESS.ORG AND FIND OUT WHO YOUR NEAREST REPRESENTATIVE IS, Dave Weldon is very helpful but not sure if he deals with your area, you might find now that you have to put in a new application, dont forget to include the info they asked for in the RFE,we have also had to do this, good luck!!!

Welcome, so sorry to hear your difficuties, Have you tried sending attorney a certified letter?
Has he replied to you in writing as to him forgetting?

It may be possible to file a motion to reopen and reconsider, not sure if this would apply in your case so recoomend you call your service centre or search on www.uscis.gov

This immigration lark sucks, bad enough that the sevice centres loose paperwork, the American cosulates employ dare I say moran's or the like now immigration attornies are suffering with forgetfulless.

The first thing you need to do is file a complaint with the Bar Assn. You then must file a motion to reopen

Hi All,
Thank you very much for you valuble postings. I don't have any proof to show that he told FORGOT to respond to the RFE. But I do have copy of the RFE that he send by fax. I refield my labor with different employer in Chicago in PERM and got approved in a week and preparing to apply for I-140 this week. But I don't want to leave this blood (Money) sucking dracula. All he wants is money once he gets his money that is it he will forget you until you remind him yourself. My priority date in california was November 2001. Is there a posibility to keep this priority date to use with my new GC in chicago?

Be careful as time is of the essence. I was concerned for you so spoke with my immigraiton attorney, all is not lost if you act quickly. I would not bother with your exsisting attorney and feel you are wasting your time if what you say is exactly what happened
As I said in my pm, you should really go to new attorney, he can help you file a motion to reopen and assist with a complaint to the bar assn.
I live in florida so I would write a complaint letter to the Florida Bar, where do you live? as you need to file a complaint letter to the Bar assn in the state you live or attorney has his/her practice, not really sure which

Yes, I do have all my W-2 forms ready but the original labor with the lawyer and also the company financial information. I live in New London, CT and the lawyer is in CA. Do I have to contact the other lawyer in the CA or will that work if I hire a lawer in the CT.

Immigration law is federal and not state practised get into that attorney immediately as time is of the essence. A complaint to the california bar assoc is easy here is the doc link

Are you re-filing or going to try to re -open old case?
To open old case, need to file the complaint to Bar assn then file motion to re-open
I am now a bit confused by your comments above

Sorry to know your problem but Noted some posts on your forum Guess what RFE is to be responded in 60 days time , and its not necessary to respond through that stupid lawer all you need to do is to sign a G28 form with your new lawer and inform USCIS about your new lawer than send the RFE details to USCIS through your new lawer ..... once you sign G28 by law your old lawer will have to give all your paperwork to your new lawer and you can continue your GC process from begining.
Wonder why no one told you that .
Also without any further delay call USCIS customer service and tell them to send the RFE to your home address as you have changed the lawer. They will resend you that again tell them you did not receive the earlier one and you cannot reach your old lawer.
No more confusions. DONT FILE AGAIN YOU WILL LOOSE YOUR PD and will have to start the process again.YOU DONT HAVE TO DO THAT. Follow as I said and have a good lawer.

Why did this lawer ask you to refile LC again ? when your I140 and I485 is already filed ?
As you have the copy of the RFE by fax why dont you sign G28 with this lawer and send a reply to the RFE ?
That will save you so much troubler/money and time.

What bothers me about this thread is all the inuendo.
There is no evidence that the lawyer made a mistake.
The " person" behind the threat says: I don't have any proof to show that he told FORGOT to respond to the RFE.
In fact, the person complaining has no details in their profile.You can't even tell if they are male or female.
How do we know this entire thread is not a set up ?
